The Legal Documents - introduction

Cornwall's Constitutional Status as intended by the creator of the Duchy of Cornwall

This is just the start in developing a suite of pages which looks at the various legal documents that were produced to support the Duchy of Cornwall in its arbitration against the Crown over the right to the Cornish Foreshore.  This, hopefully, must hasten a more informed, sincere and truthful debate about our Duchy and how the United Kingdom Government, in collusion with both the Crown and the Duchy, wilfully misrepresent Cornish History and Cornish Rights.

At this early stage, in posting the transcript of the "Cornish Foreshore Case" to this site, only the Duchy arguments will be posted.  Whilst this may seem as if it presents a one-sided case, it should be noted that the Duchy argument does, in fact, make continual references to the contrasting view put forward by the Crown.  In time, the "Red Ink Remarks" which the Duchy added to the "Observations of the Crown in reply to the Duchy Preliminary Statement" will be considered for posting to the site.  In the meantime, the Duchy "Replies" adequately covers this omission.

These documents have been OCR scanned from the original transcripts in order to put them out into the public domain.  A reasonable check has been done to verify/correct the accuracy of the OCR scan, before posting to the site, but please feel free (click on the logo) to bring to our attention anything that might look as if it might be an error.

Use of italics and quote marks are by the original authors of the documents - Colour highlighting and square brackets by TGG.  Much of the referenced items will not yet be available but, over time, I shall include what is easy to include and colour highlight the referencing note accordingly - when available as a link.  Priority, in this respect, will be given (if practicable) to any specific request for an item of information.  The key: don't expect everything at once!

The numbers down the left hand side of the submissions' selection index represents the chronological position of a particular submission and numbered from 01 to 14. - any letter/number suffix will refer to an associated Appendix item.   As an Appendix item becomes posted to this site, referencing links will be embedded within the relevant associated text comment.

NB. The legal documents contained here have, as appropriate, previously been translated from the original Latin text [by others] and readers should bear in mind that 'Earldom/County' [the territory presided over by the Earl/Count, will be a modern translation of 'Comitatus, or Earldom, etc.'  Similarly, 'Shrievalty/county' [the territory under the jurisdiction of the Sheriff and, uniquely, the officer of the Earl/Duke in Cornwall] is normally a translation of 'Vicecomitatus' but is territorially coextensive with the Comitatus.
