Dear Sir,

This organisation operates a Cornish Rights information website [address below] and I am seeking to collate copies of all Reports which:

ahave been submitted to the United Kingdom Home Office, by interested Cornish organisations, to support the claim of the Cornish Right to the recognition of our historic nationality

and, following the subsequent failure of the State to provide that recognition:

bAny representations made to the Council of Europe's Directorate of Human Rights to challenge the validity and integrity of the United Kingdom Compliance Report - currently being examined by that Directorate.

As your Council is charged with the constitutional protection of the Cornish People, within the Duchy, I would be grateful if it would be possible to be provided with copies of any relevant reports for review on the website?

Dear Mr Pengelly,

... The Chairman asked me to respond on his behalf...

I am not sure the County Council can help with your request.   All our Committee decisions are freely available for inspection by the public, and I can arrange for you to do so if you so wish.   The County Council is granted certain powers to discharge specific statutory functions but it is not, as you put it 'charged with the constitutional protection of the Cornish people'.

Dear Mr Sawle,

Thank you for your letter dated 18th May.   I am sorry to note that the Chairman feels unable to respond directly to my letter and I hope that you will please bring this reply to his attention?

I am even more sorry that there is no acknowledgement that your council has an inherent responsibility to protect the fundamental human rights of the Cornish people [the electorate!] and even a categorical statement to the effect that it has no such function.  I am, therefore, confused as to why:

ayour council has finally felt a need to call for the inclusion of a 'Cornish' dimension in the 2001 Census;
bthe Cornish Flag of St Piran is flown outside your council's offices, and ;
cthe council crest comprises symbols representative of Cornwall's distinctive non-English status and constitution and the motto is in both Cornish and English?
The original reason for writing to the Chairman was to enquire into where the council stands with regard to Cornish Rights, in the light of the United Kingdom's ratification of the Council of Europe's Framework Convention on the Protection of National Minorities and the failure of that government to acknowledge the inalienable right of the Cornish people to be recognised as one of the historic indigenous national groups of Britain - as history and the Cornish people demand.   Whilst accepting the ignorance and intransigence of an external administration one may be forgiven for expecting better things from a council elected by the Cornish people.

It is clear from the de jure constitution of the Duchy of Cornwall that the Government of Cornwall was, and is intended, to be the responsibility of the Dukes of Cornwall or their successors "Forever" and that this confers an obligation "that he may preside there, and by presiding, may direct and defend the said parts".   Your council - albeit directed by the UK Parliament [on behalf of the Duke] - is ultimately responsible to the Duchy of Cornwall and its people.   In the absence of concern and sensitivity towards the Cornish people by both the Duchy and the Crown it must be the moral and constitutional duty of Cornwall's only elected and representative body - your council! - to protect our Cornish Rights.   I would be grateful to be advised on how, and when, I may submit a paper on this topic for discussion by the full council?

To whom it may concern,

Firstly, may I please apologise to you for communicating by means of a standard letter.   The reason for this is to simplify the effort in communicating with so many.   Bureaucracy definitely has a place and Tyr-Gwyr-Gweryn similarly puts its faith in a Cornish Rights website - address below.

I enclose, for your information, a copy of a letter sent as a reply to John Sawle at the Private Office of our Cornish Administration in Truro and dated 31st May 2000.   I hope you will find the enclosure of interest and that you may feel able to comment upon it.

The context of the letter is that this organisation is seeking clarification from various official bodies as to who sees themselves as having both a moral and a constitutional duty to protect the rights and interests of the Cornish people.   Given that the United Kingdom Government [the Duchy and the Crown] seem intent on denying us our rights, and it can be shown that policies are being implemented which wilfully threaten our very existence, there is a need to establish once and for all an open debate and an independent external investigating commission into 'The Reasons Why?'

The existence within the Duchy of a county administration during the past century has been a significant 'external' instrument in implementing the above policies of cultural genocide of the Cornish people.   There has recently, however, been an insignificant shift with a tenuous recognition of some aspects of Cornish history, but, running parallel to an insidious manipulative process, by government and media, of fragmenting Cornish people's perceptions of their Cornish territorial relationship and self-identity.   A moratorium needs to be implemented so that all this may be examined under an independent 'microscope' and made public.   The Cornish are entitled to their rights.   The question is: what are you going to do about it?
