The Government presented its Draft 2nd Compliance Report to the Advisory Committee on 12 December 2006, almost three years after its due date, for a suspiciously brief consultation with those concerned, before its submitting its final report to the Advisory Committee on the Framework Convention. The deadline for responses was by the 20th January 2007.

Cornwall 2000 pursued an action against the Home Office, Department for Communities and Local Government (DCLG), in an attempt to obtain a Temporary Injunction to prevent the 2nd Compliance Report being submitted to the Council of Europe's Advisory Committee until the Report had been the subject of a Judicial Review in the High Court. This Temporary Injunction failed to be achieved for the most bizarre reasons, and with a high court judge rewarding the 'dirty tricks' of the UK Government, as presented by the Secretary of State for the DCLG, Ruth Kelly's Counsel. The UK 2nd Compliance Report was not submitted to the Council of Europe until the last day of the plenary hearing established to look into UK Compliance. The Committee of Ministers of the Council of Europe gave the Advisory Committee authorisation last August to begin monitoring the UK in the absence of a state report in view of the
